A woman seeking divorce, Faithful, has dragged her husband, Felix, before Grade A Customary Court, sitting in Mapo, Ibadan, Oyo State, alleging irresponsibility,  lack of love and abandonment as her reasons.

Faithful told the court that Felix, whom she was married to for twenty-five years and had three children for, suddenly abandoned her and their children five years ago and refused to return home.

Faithful stated that she had bore the responsibility of their children’s upkeep, most especially feeding and education since he deserted them.

According to the plaintiff, all attempts made by her parents and herself to make the defendant come back home failed.

She added that she made her plight known to her husband’s family but that no positive step was taken.

Faithful said that she had waited enough for her husband and had decided to move on with her life.

She thus prayed the court to end their relationship.

Felix was absent in court even though he was served with several hearing notices.

Faithful, in her testimony, said, “My husband and I got married on October 5, 1996, and our wedlock is blessed with three children.

“Our union like any other one was filled with its ups and downs, but we were able to waddle through.

“As was our usual routine, we both left home for work, hoping to gather together again as a family in the evening to eat, chat and go to bed.

“As was the norm, I got home early than my husband, and went straight to the kitchen to prepare dinner.

“The children also returned home and then the endless wait for my husband began.

“After taking the necessary steps in knowing his whereabouts, I discovered all was well him. He just decided to abandon me and our children.

“All the appeals made by my parents that he returned home fell on deaf ears.

“I informed his parents also, but they took no positive step.

“I later resigned to fate.

“I have been responsible for our children’s upkeep since my husband left home.

“Their feeding and education especially gulp my income.

“My lord,  I have waited endlessly for my husband for the past five years and cannot wait any longer.

“I pray that the court end our marriage and grant me custody of our children.

“I also plead that the court orders my husband to be responsible for our children’s upkeep, giving feeding, education and health care utmost attention.”

The president of the court, Mrs S.M Akintayo,  giving her judgment said both parties held a valid customary marriage which the court has jurisdiction over.

Akintayo said that the plaintiff emphatically stated that she was no longer interested in the continuation of their union having waited endlessly for the return of her husband who abandoned her and their children for the past five years.

Akintayo ruling said that the plaintiff, having showed satisfactory that the marriage had broken down, the court had no choice but to grant her request.

Ruling, she pronounced the customary law marriage celebrated between the parties on October 5, 1996, dissolved.

According to her, the parties ceased to be husband and wife forthwith.
